5 Reasons to Vote NO on Prop 201

1. Drafted in Secret!
Prop. 201 was drafted in secret by California trial lawyers without legal review or any open public hearings. If it passes, it can’t be changed for any reason without another vote of the people.
2. Plaintiffs don't need to own a home to sue someone!
Prop. 201 allows so-called “prospective buyers” who didn’t even buy the house to sue home sellers – and collect money! Trial lawyers will be able to recruit plaintiffs and share in the loot by filing frivolous lawsuits. 201 is a blank check for lawsuit abuse!
3. 201 prevents people from solving problems out of court.
Prop. 201 would leave Arizona buyers and sellers with only one way to resolve construction problems: expensive lawsuits. The trial lawyer who drafted this law added provisions that prohibit buyers and sellers from resolving problems through mediation of dispute resolution. The trial lawyer who wrote 201 doesn’t want problems solved: he wants lawsuits and legal fees!
4. Lawyers and plaintiffs can collect money for reasons unrelated to a housing defect.
Read 201 for yourself. Unscrupulous lawyers and the clients they recruit can collect money and need not show any defect in the house! They can even refuse repairs and just demand cash.
5. Prop. 201 is unfair.
If you get dragged into court and are proven innocent, should you get your legal fees paid back? Not if 201 passes! 201 says that innocent sellers may not recover legal costs for “any” reason even if they win in court!
